Being realistic in revising the Youth Law

Web.HCYU.28/8/2019. The revised Youth Law must be really feasible and innovative to tackle new challenges via suitable resolutions. The Conference “Social Criticism on Youth Law Proposal” complement the Proposal by critics from Leaders of Ministries and scientists.

The Conference "Social criticism on Youth Law Proposal (amended)" was held on August 28 in Hanoi with the participation of numerous leaders of ministries; experts and scientists.

The Proposal of the Youth Law (amended) consists of 6 Chapters and 62 Articles; an increase of 26 Articles, compared to the 2005 Law, including: Regulations on dialogue with youth, Youth Month and ensuring resources for implementing youth development policies; Regulations on the responsibilities of young people in the development and defense of the Fatherland; the State's responsibility toward young people and specific youth groups; Clarification of the responsibilities of youth organizations; Regulations on the responsibilities of the family, school and society towards the youth.

Practicality of the Proposal

 Mr. Ngo Duy Hieu, Vice President of the Vietnam General Confederation of Labor, said that the proposal of the Youth Law (amended) had a newer and closer approach and solved more youth issues, but  still need to be more scientifically rigid and feasible  to meet the youth's expectation of a complete set of laws for a specific target group.

 He said that the 2005 Youth Law has not had much impact on the lives of young people. So he hopes that this Proposal would be really comprehensive to meet the needs and aspirations of young people, as well as being suitable for each age group and young people.

“It is necessary to pay attention to the aspirations of young people to study and work. For the Law to be truly meaningful, feasible in practice, to be welcomed by young people, it is necessary to arouse the youth's dedication with clear legal corridors and sanctions. ” He insisted.

He commented that there should have explanations of the words used in the Law to suit the scope of adjustment and subjects of application. The Law also need to define the range and domain for its application. For instance young people from 16-18 years old; talented young people; disadvantaged young people are different and separated group of young people whom need different ways to approach.

Reflecting the current situation of young people who are talented people of the country, but not keen on working in the public sector, Mr. Ngo Duy Hieu said: “The country is in need of many talented people, but the talented people all choose to go abroad to start a business or secure a job in private sector, perhaps because the policy is not really suitable to attract talented people to work in the public sector. ”

In addition, the way young people in industrial zones prescribed in the Law are not clear enough, and need a specific regulation of local authorities to provide healthcare and insurance for workers, as well as education for children of those who are contributing directly to local development.

According to Mr. Vu Mao, former First Secretary of the Central Committee of the Ho Chi Minh Communist Youth Union, the revised Youth Law should  specify the rights and responsibilities of the National Committee on Youth of Vietnam, as well as those of other ministries as supporters in youth issues.

Reasonable policies create motivation for Youth to devote

Mr. Vu Trong Kim, former First Secretary of the Central Committee of the Ho Chi Minh Communist Youth Union said that revising the Youth Law is a good opportunity for the policy makers to create a brand new and more straightforward approach to the Youth sector. This is a specific demographic group as it represents future owners of the country.

However, the content of the Proposal  is still scattered. He said that the Law should focus more on three main factors in the rights and obligations of young people, including: learning and training; protecting the Fatherland and maintaining the security and order of society; contributing to socio-economic development.

“The Youth Law is not only to address the aspirations of young people, but also to support, energize and inspire young people to study, train and contribute. In order to do so, it is necessary to have really appropriate policies, as well as clear and specific responsibilities of ministries to motivate young people to implement, ”said Mr. Vu Trong Kim.

At the Conference, Mr. Le Quoc Phong received comments and requested the drafting committee to synthesize ideas to submit to the Ministry of Home Affairs for further research. The Youth Law is reserved for the important force, the generation that decides and promotes the development of Vietnam, so the new policies and regulations will be more feasible than the 2005 Youth Law. 

In addition, Mr. Le Quoc Phong also said that it is necessary to clarify the role, operation mechanism and responsibilities of the relevant agencies mentioned in the Youth Law (amended). The more specifically the responsibilities are, the more effective the law enforcement and monitoring mechanism will be. Mr. Phong hoped that the Ministry of Home Affairs would create a new face for the revised Youth Law.

“If we choose a safe way to draft and do not create the breakthrough for the Proposal, the Law will only lie on paper and cannot be implemented practically", Mr. Le Quoc Phong emphasized.

On this occasion, many participants participating in the Conference also commented on a number of rights and obligations for some specific youth groups, such as young women, young volunteers, young  scientist, ethnic youth, disadvantaged youth groups ... to create the equality among young people. There are also ideas on how to present and structure the chapters and words used in the draft of the Youth Law (amended); Dialogue with youth and regulations on Youth Month.
